Abstract:
The paper is focused on the conflicting relationship between rights, recognition and identity, which tightens the contemporary feminist activists and sociosexual movements dissenting from heteronormativity. In this tension, there is an end demanding the recognition of its identities and fighting for its inclusion in the existing institutional order; that is, they subscribe identity politics. While the other end is a more radical one, which undermines even the pretension of identity and from a queer practice it intends to dismantle what is established rather than consolidating a position. Of course, in practice there are many aspects, groups and demonstrations that maintain the ambivalence of looking for laws that empower a certain level of recognition, but without giving up the resistance nor the creation of strange senses that are not let in the language, in the laws, in the rights. To understand this specific conflict and what is happening in Argentina, the process will be provided for a context in the contemporary control society, characterized by the covering of power devices (Foucault), sexuality (Foucault) and gender (Preciado). In particular, we will introduce some situations that happened before and after the achievement of the Gender Identity Law (LIG Nº 26743).

El eje de este artículo lo traza la relación conflictiva entre derechos, reconocimiento e identidades, que tensa las militancias contemporáneas de los feminismos y los movimientos sociosexuales en disidencia con la heteronormatividad. En esa tensión, el extremo que lucha por la inclusión en el orden institucional vigente se apoya en la exigencia de reconocimiento de sus identidades; es decir, subscribe políticas de la identidad, mientras que el extremo más radicalizado socava incluso la pretensión de identidad y, desde un accionar cuir, pretende desmontar lo establecido antes que consolidar una posición. Por supuesto, en los hechos se encuentran muchos matices, agrupaciones y movilizaciones que van sosteniendo la ambivalencia de buscar leyes concretas desde cierto nivel de reconocimiento sin abandonar la resistencia, la generación de sentidos impropios para los que no hay todavía lugar de inscripción en el lenguaje, en la ley, en los derechos. Para entender esta conflictividad y el modo específico que está teniendo en Argentina, contextualizaremos dicho proceso en la sociedad de control contemporánea, caracterizada por el encabalgamiento de los dispositivos de poder de alianza (Foucault), de sexualidad (Foucault) y de género (Preciado). En particular, reflexionaremos sobre situaciones previas y posteriores a la obtención de la Ley de Identidad de Género (LIG Nº 26743).
