Intelligenza artificiale, potere normativo e bene comune nell'Unione europea

Il presente articolo esamina l’attuale quadro normativo dell’Unione europea in materia di intelligenza artificiale (IA), in fase di consolidamento, come vettore di potere normativo nell’Unione europea che incide direttamente sull’autorità pubblica, sui diritti fondamentali e sulla configurazione del bene comune. Partendo dalla premessa che l’IA non è uno strumento neutro, ma un’infrastruttura con effetti costituzionali, l’articolo sostiene che la regolamentazione non può limitarsi a una logica tecnica o di gestione del rischio, ma richiede un fondamento costituzionale e umanistico. L'articolo analizza il quadro normativo dell'UE, in particolare l'Artificial Intelligence Act, e sostiene che i limiti sostanziali al processo decisionale automatizzato derivano dalla centralità della persona umana e dai requisiti del bene comune. Propone infine una ricostruzione umanistica della governance algoritmica volta a preservare un nucleo irriducibile di processo decisionale umano e a rafforzare la responsabilità democratica.
