Inteligencia artificial, poder normativo y bien común en la Unión Europea

Este artículo analiza la inteligencia artificial (IA) como un vector de poder normativo en la Unión Europea que incide directamente en la estructura de la autoridad pública, la protección de los derechos fundamentales y la configuración del bien común. Partiendo de que la IA no es una herramienta neutral, sino una infraestructura con efectos constitucionales, se sostiene que su regulación no puede limitarse a una lógica técnica o de gestión de riesgos, sino que exige una fundamentación constitucional y humanista. El estudio examina el marco regulatorio europeo vigente y en consolidación, en particular el Reglamento de Inteligencia Artificial, y argumenta que existen límites materiales a la toma de decisiones automatizada derivados de la centralidad de la persona y de las exigencias del bien común. Finalmente, se propone una reconstrucción humanista de la gobernanza algorítmica orientada a preservar un núcleo irreductible de decisión humana y reforzar la rendición de cuentas democrática.
