Abstract

Restorative justice is postulated as a new way of making amends within our criminal justice system, encouraging the active participation of the victim, the offender and society. Criminal mediation is currently one of the most widely used restorative tools. Through a qualitative analysis of official statistical data and some academic research, key issues such as reoffending rates are addressed. In addition, the presence of restorative justice in the Organic Law 5/2000, of 12 January, regulating the criminal responsibility of minors and the current state of mediation in legal practice will be analysed. It also briefly examines the implementation of restorative justice and, more specifically, mediation in Germany. The results of this work show that, despite the difficulties, in recent years there has been a clear will to apply this restorative practice, a greater involvement of the judicial authorities, a commitment to de-judicialisation, a preventive effect of this restorative model against recidivism and a positive trend in the desistance of minors from criminal behaviour.
