Deferral of the execution of prison sentences for mothers of children under three years of age and the possibility of replacing it with home detention
Existing measures in the Italian legal system to be envisaged in the Spanish legal system

In this paper we will defend the necessity of betting on housing alternatives where convicted mothers can serve the prison sentence imposed together with their children under three years of age, but also, and above all, the convenience of providing alternatives to serving the sentence itself and, more specifically, to allow the deferral of the execution of the sentence until the children to be served reach that age, with the possibility of replacing it with home detention if deemed necessary in order not to frustrate the requirements of security. Both possibilities are provided for in the Italian legal system and will be analysed in this article, in order to know what they consist of, what are the requirements for granting them and who is the competent authority for this purpose, but also with the hope that they will serve as inspiration for the Spanish legislator when it comes to taking the necessary path towards the decarcelation of convicted mothers and, consequently, in favour of a penal execution sensitive to the interests of the minors.Downloads
