Undercover agent in the face of transnational organised crime

Abstract

The State, after assuming a monopoly of power in an exclusive way over its territory and the people who reside in it, becomes the sole sovereign. Although, in recent decades, state sovereignty has suffered a process of wear and tear or degradation on its foundations and structures, which in turn has generated power gaps that threaten democratic societies.  These weaknesses are taken advantage of by transnational organized crime, which requires, among other measures, special investigative techniques such as undercover agents and technological secret agents to prevent its proliferation. An interstate competition is essential to carry out an effective fight to prevent its spread. From this need, Joint Investigation Teams are formed at the EU level, with the ability to have the support of Europol and Interpol, and there is even a trend towards global regulatory harmonization to facilitate, from legality, interstate coordination.
