SISTEMAS ALTERNATIVOS DE RESOLUCIÓN DE CONFLICTOS EN EL DERECHO CONSUETUDINARIO SARDO
Abstract
En el presente trabajo se reconstruyen los procedimientos consuetudinarios de resolución de confl ictos en algunas áreas de Cerdeña. La investigación empírica, llevada a cabo por la autora en un arco temporal de treinta años, evidencia la existencia de estas formas consuetudinarias de resolución de confl ictos a través de procedimientos casi idénticos en muchas áreas geográfi cas de Cerdeña, en particular en las zonas Barbagia, Ogliastra, Logudoro, Campidano, Gallura. Su difusión está relacionada con acontecimientos históricos y sociales que hacen de estas formas tradicionales de composición de confl ictos idóneas para responder a las exigencias de las comunidades, y a la concienciación individual y comunitaria de los efectos que un confl icto sin resolver podría provocar: enemistades entre grupos (disamistades), venganzas, peleas. Son formas tradicionales difundidas por todo el mundo, tal y como atestiguan fuentes literarias y jurídicas, que encuentran en la actualidad un renovado interés por la exigencia cada vez mayor de llegar a una resolución negocial de los confl ictos.Downloads
