Résumé

El presente texto es una recensión de la obra de Daría Terrádez, su primera monografía, y que tiene como principal objetivo demostrar que el reconocimiento de los derechos sociales no puede ser sometido a la posible bonanza económica de ningún Estado social y democrático de derecho que se precie. Durante los años más crueles de la crisis, los derechos sociales han sido desprovistos de sus garantías, poniendo en serio peligro el Estado social. Todo ello ha tenido lugar ignorando uno de los tratados internacionales más importantes en materia de derechos sociales, la Carta Social Europea, reivindicada por la autora como pieza clave para mitigar los efectos de una crisis económica que aún se sienten.

This paper is a review of the work of  Daría Terrádez, her first monograph, and which has as main objective to demonstrate that the recognition of social rights cannot be subjected to the possible economic boom of any social and democratic State of law that is worthy of the name. During the cruellest years of the economic crisis, social rights have been deprived of their guarantees, seriously endangering the welfare state. All of this has been perpetrated ignoring one of the most important international treaties in the field of social rights, the European Social Charter, which is claimed by the author as a key piece to mitigate the effects of an economic crisis that is still being felt.
