LA CONCEZIONE POSITIVISTA DELLE FONTI DEL DIRITTO E L’ANALISI CRITICA DELLE LACUNE DELL’ORDINAMENTO GIURIDICO SECONDO LUIGI LOMBARDI VALLAURI
Abstract
Il positivismo giuridico è la teoria giuridica secondo cui può considerarsi come “diritto” nel senso proprio del termine soltanto il diritto positivo, ossia il diritto posto da coloro i quali sono investiti dell’autorità necessaria a produrre norme giuridicamente vincolanti. Il positivismo giuridico si caratterizza soprattutto per il principio della supremazia del diritto che emana dallo Stato e per un’attitudine neutrale, dal punto di vista etico, del giurista nei confronti del diritto. Dopo aver esaminato la connessione che esiste tra i principi fondamentali della teoria positivista da un lato e i concetti di separazione dei poteri e di parlamentarismo democratico dall’altro, l’articolo analizza alcuni passaggi tratti dal lavoro di critica delle lacune dell’ordinamento giuridico svolto dal filosofo italiano Luigi Lombardi Vallauri.Downloads
