Pilar Europeo de Derechos Sociales y sistemas de seguridad social

Resumen

Los sistemas de protección social (y la Seguridad Social como el subsistema más importante) son la piedra angular del modelo social de la Unión Europea y de un buen funcionamiento de la economía social de mercado. Unos sistemas de protección social bien construidos pueden también facilitar la participación en el mercado de trabajo apoyando la transición en el mercado de trabajo de las personas. La iniciativa comunitaria (Propuesta de “Recomendación” del Consejo, relativa al acceso a la protección social de todos los trabajadores) trata de garantizar que los sistemas nacionales de Seguridad Social avancen en la misma dirección y al mismo tiempo. De esta manera se pretende fomentar la convergencia de las legislaciones nacionales para conseguir mejores condiciones de vida y de trabajo, en consonancia con el objetivo del “Pilar Europeo de Derechos Sociales”. Y esto será positivo para la economía (racionalidad económica) y la “justicia social” (que es la razón de la sociedad) de la Unión Europea en su conjunto. Se busca implantar un estándar de garantías mínimas de protección social. Ahora bien, en esta investigación se apuesta por ir más allá de una simple convergencia de objetivos de los sistemas nacionales de protección social enmarcada en el enfoque del “Pilar de Derechos Sociales” formalizado en un instrumento jurídico sin fuerza normativa vinculante (típica manifestación del soft law comunitario), para pasar a un modelo de regulación jurídica basada en la incorporación de los derechos sociales en el Sistema de los Tratados fundacionales y en el Derecho comunitario derivado; y en particular se aportan fundamentos sobre la necesidad y viabilidad técnica y político jurídica de crear un auténtico Derecho Europeo de la Seguridad Social que efectivamente garantice un estándar mínimo comunitario de derechos a las prestaciones sociales.

Social protection systems (and social security as the most important subsystem) are the cornerstone of the European Union's social model and a good functioning of the social market economy. Well-constructed social protection systems can also facilitate labour market participation by supporting the transition in people's labour market. The Community initiative (proposal for a "recommendation" of the Council on Access to Social protection of all workers) seeks to ensure that national social security systems move in the same direction and at the same time. In this way, the aim is to promote the convergence of national legislation in order to achieve better living and working conditions, in line with the objective of the 'European pillar of social rights'. And this will be positive for the economy (economic rationality) and "social justice" (which is the reason for society) of the European Union as a whole. It seeks to implement a standard of minimum guarantees of social protection. However, this research is committed to go beyond a simple convergence of objectives of the national systems of social protection framed in the approach of the "pillar of social rights" formalized in a legal instrument without normative force Binding (typical community soft law manifestation), to move to a model of legal regulation based on the incorporation of social rights in the system of the founding treaties and in the derived Community law; And in particular they provide fundamentals about the need and technical and political feasibility of creating a genuine European social security law that effectively guarantees a minimum community standard of entitlement to social benefits.
