Cette communication prétend effectuer une analyse de l'arrêt de la Cour Constitutionnelle espagnole en relation avec le contrat d'appui aux entrepreneurs, lequel établit une durée excessive de la période d'éssai. Ce bref étude analyse les argumentations juridiques de la Cour en les comparant avec les arguments du vote dissident de trois magistrats.
